Beyond Brexit: Curve Will Continue To Recruit Top European Talent

Brexit is scheduled for 31st January 2020; and we want to be very clear: Curve will continue to recruit the best from the EU and beyond. We have over 200 team members, made up of 40 different nationalities, and we don’t plan on stopping there.

Here’s Curve’s quick guide to what you need to do to ensure you can continue to work in the UK if you’re a European non-British national.  (Of course, this quick guide isn’t a substitute for reading the official guidance but should be a good starting point! ??)

What should I do if I’m an EU, EEA or Swiss national living in the UK?

Unless you already have ‘Indefinite Leave To Enter Or Remain in the UK’ or you hold British or Irish citizenship, you will need to make an application to the Home Office to obtain ‘Pre-Settled’ or ‘Settled Status’ to remain in the UK under the EU Settlement Scheme. Luckily you’ve got plenty of time to do this. The deadline to apply is 30th June 2021.

So what exactly is ‘Settled Status’ and what criteria do I need to meet?

  • ‘Settled Status’ is the equivalent of permanent residency in the UK.
  • You get the same rights as British citizens after Brexit. This includes equal rights on healthcare, education, benefits and pensions. 
  • You and your family can apply for Settled Status if you’ve lived in the UK for five years or more, haven’t spent over six months overseas in any 12-month period and don’t have a serious criminal record. 
  • It’s worth bearing in mind, if you gain Settled Status then spend more than five years outside the UK, the status will lapse.

What if I don’t meet the criteria to apply for ‘Settled Status’?

For Europeans with less than five years’ residence you will be able to apply for ‘Pre-Settled Status’ before switching to Settled Status after five years of continuous residence in the UK.

Is it worth applying for ‘Settled Status’ if I’m an EU, EEA, Swiss national who already has ‘Indefinite Leave To Enter Or Remain in the UK’?

If you already have Indefinite Leave To Enter Or Remain in the UK or if you hold British or Irish citizenship (including ‘dual citizenship’) then there’s no need to register for settlement. But if you do, it would mean being able to spend up to 5 years in a row outside the UK without losing your Settled Status (instead of 2 years with the ‘Indefinite Leave To Enter Or Remain’ you have now).

I’m an EU, EEA, Swiss national with ‘Permanent Residence’ here. Do I need to apply?

If you already hold Permanent Residence, you will need to apply for Settled Status as you are required to convert your status from the 2016 Regulations. Any EU, EEA, Swiss national or dependant family members who wants to remain in the UK will need to make an application under the scheme.

How do I apply and what do I need?

You can apply here on the UK government’s website. You’ll need proof of:

  • An email address and phone number.
  • Your current passport or national identity card, if you are an EEA or Swiss national.
  • Your current passport or UK residence card with a biometric chip, if you are not an EEA or Swiss national.

The scheme is open – you can apply now if you’re eligible. If you’re applying for Pre-Settled Status, you’ll need to apply again when you’re eligible for Settled Status. Oh, and by the way, it’s free to apply to the scheme.
